Terms of Service

These Terms of Service (“Terms”) govern your use of ProfitPilot (“the App,” “we,” “us,” or “our”), a Shopify application that provides AI-powered profit analysis and financial insights. By installing or using ProfitPilot, you agree to these Terms.

1. Service Description

ProfitPilot is an AI-powered financial analysis tool for Shopify merchants. The App:

• Syncs your Shopify product and order data to calculate true profit margins
• Uses AI to estimate cost of goods sold (COGS) when actual costs are unavailable
• Provides a profit dashboard with per-product breakdowns
• Tracks business expenses by category (advertising, subscriptions, shipping, software, wages, other)
• Detects financial anomalies by comparing recent performance to prior periods
• Generates AI-powered profit optimization recommendations
• Sends daily profit briefings and alerts via Telegram (when connected)
• Sends weekly email reports with AI-generated analysis (when enabled)
• Supports CSV cost import and manual cost entry

2. Account and Installation

• You must have an active Shopify store to use ProfitPilot.
• By installing the App, you authorize us to access your store data as described in our Privacy Policy.
• You are responsible for maintaining the security of your Shopify account.
• One ProfitPilot subscription covers one Shopify store.

3. Pricing and Billing

• Free Plan: $0/month USD, no billing required. Limited to 50 products and 100 orders per month.
• Starter Plan: $14/month USD, billed every 30 days through Shopify Billing. 7-day free trial.
• Pro Plan: $29/month USD, billed every 30 days through Shopify Billing. 14-day free trial.
• Growth Plan: $59/month USD, billed every 30 days through Shopify Billing. Overage: $0.005 per order above 5,000/month.
• Billing: All billing is handled through Shopify's Billing API. We do not collect or store payment information.
• Cancellation: You can cancel anytime from the ProfitPilot settings page or your Shopify admin. You retain access until the end of your current billing period.
• Refunds: Refund requests are handled in accordance with Shopify's App Store refund policy.

4. AI-Generated Content and Disclaimers

ProfitPilot is not a financial advisor. The App provides AI-generated estimates, analysis, and recommendations for informational purposes only.

• AI cost estimates are approximations based on product categories and pricing patterns. They may be inaccurate. Always verify with your suppliers.
• Profit calculations are only as accurate as the cost data you provide.
• AI recommendations are suggestions, not guarantees. Predicted savings are estimates and actual results may vary.
• AI expense predictions are forecasts based on historical patterns. They are marked as “predicted” in the app and replaced automatically when real transaction data arrives. Predicted expenses may be inaccurate.
• You are solely responsible for any business decisions made based on ProfitPilot's data or recommendations.
• Nothing in the App constitutes professional financial, tax, or legal advice.

5. Data Accuracy and Your Responsibilities

• You are responsible for the accuracy of cost and expense data you enter (manually or via CSV).
• We sync product and order data from Shopify but do not guarantee real-time accuracy.
• Profit figures may be understated or overstated if costs or expenses are missing, estimated, or incorrect.
• Anomaly detection compares the last 7 days to the prior 7 days. Short-term fluctuations may trigger alerts that do not reflect longer-term trends.
• You should not rely solely on ProfitPilot for financial reporting or tax purposes.

6. Approved Actions and Undo

When ProfitPilot recommends changes to your Shopify store (such as price adjustments):

• Changes are only applied when you explicitly approve them.
• During the first 30 days, approval requires typing “CONFIRM” for safety.
• Approved changes can be undone within 48 hours using the “Undo” feature.
• You are responsible for reviewing and approving any changes to your live store.

7. Acceptable Use

You agree not to:

• Use the App for any illegal purpose
• Attempt to reverse-engineer, decompile, or extract the source code
• Share your account access with unauthorized parties
• Use the App to process data for stores you do not own or operate
• Exceed reasonable API usage limits or attempt to overload our systems

8. Service Availability

• We aim for high availability but do not guarantee uninterrupted service.
• The App depends on Shopify's API, Supabase, and third-party AI services. Outages in these services may affect ProfitPilot.
• We may perform maintenance with reasonable notice when possible.
• We reserve the right to modify, suspend, or discontinue features with notice.

9. Intellectual Property

• ProfitPilot and its features, design, and code are owned by us.
• Your store data remains your property. We claim no ownership of your data.
• You grant us a limited license to process your data solely to provide the App's functionality.

10. Limitation of Liability

To the maximum extent permitted by law:

• ProfitPilot is provided “as is” without warranties of any kind.
• We are not liable for any indirect, incidental, special, or consequential damages.
• We are not liable for losses resulting from decisions made based on our AI recommendations or estimates.
• Our total liability is limited to the amount you paid for the App in the 3 months preceding the claim.
• We are not responsible for losses caused by Shopify API changes, third-party service outages, or data inaccuracies in your Shopify store.

11. Termination

• You can terminate your use by uninstalling the App from your Shopify admin.
• We may terminate your access if you violate these Terms.
• Upon termination, all your data is deleted within 48 hours (per our GDPR compliance).

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via Telegram. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict of law provisions.
